These Consumer Terms of Service govern your use of product experiences accessed through QR codes on the Cxperia platform. If you are a Brand using Cxperia's services, please review our Brand Terms of Service.
Cxperia ("Cxperia", "we", "us" and "our") provides technology services that enable beauty and cosmetic brands ("Brands") to create and manage interactive digital product experiences, loyalty programs, and customer engagement. These Consumer Terms of Service (this "Agreement") is a legal agreement between you and Cxperia and governs your access to and use of product experiences provided by Brands through the Cxperia platform (the "Platform").
This Agreement applies to "End-Consumers" (individuals who access product experiences via QR codes, participate in loyalty programs, earn and redeem Glowies, and interact with Brand content). "You" and "your" refers to you as an End-Consumer.
Note: Brands using Cxperia's services are subject to separate Brand Terms of Service. If you are a Brand, please review our Brand Terms of Service.
By accessing or using any product experience provided through the Platform, you accept and agree to be bound by and comply with this Agreement. If you do not agree to this Agreement, you are not permitted to access or use the product experiences.
We reserve the right in our sole discretion to amend this Agreement from time to time by publishing an amended version on our website. All such amendments are effective immediately when published and apply to your continued access to and use of product experiences. Your continued access to and use of product experiences will be your acceptance of any such amendments.
To participate in loyalty programs and earn Glowies, you must provide a verified email address. Email verification is required to save Glowies balances and redeem offers. You are responsible for maintaining the security and confidentiality of your email address and for all activities that occur under your email address.
You must notify Cxperia immediately if you become aware of any unauthorized use of your email address or any other breach of security. Cxperia is not liable for any loss or damage arising from your failure to comply with this section.
Glowies are a proprietary virtual loyalty currency with no cash value. Glowies are not property, cannot be sold, transferred, or exchanged for cash, and do not constitute a security or financial instrument. Cxperia may modify, suspend, or terminate the Glowies system at any time without liability.
Glowies may be earned through various activities as determined by each Brand. Loyalty tiers and their requirements are set by each Brand. Cxperia does not guarantee the availability of any specific earning method or tier benefit. Brands are responsible for clearly communicating earning methods and tier requirements to their End-Consumers.
Cxperia reserves the right to change Glowies award rates, tier requirements, redemption values, or any aspect of the loyalty system with 30 days' notice to Brands. Brands are responsible for communicating any material changes to their End-Consumers. Cxperia is not liable for any changes made to the Glowies system.
Brands are solely responsible for all aspects of redemption offers, including:
Important: Cxperia acts solely as a technology platform to facilitate the redemption process. Cxperia is not a party to any transaction between Brands and End-Consumers and assumes no liability for unfulfilled, expired, or misleading redemption offers.
Any disputes regarding Glowies balances, redemption offers, or rewards must be resolved directly with the Brand. Cxperia has no direct liability to End-Consumers regarding Glowies balances, redemption offers, or rewards. End-Consumers use the Glowies system at their own risk.
Product experiences accessed through the Platform contain content created and owned by Brands ("Brand Content"), including product information, ingredient lists, tutorials, images, videos, and other materials. Brand Content is owned by the respective Brand and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and view Brand Content solely for your personal, non-commercial use in connection with the product experience. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Brand Content.
The Platform and its technology, design, and functionality are owned by Cxperia and are protected by copyright, trademark, patent, trade secret, and other laws. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Cxperia Content.
If you provide feedback, comments, or suggestions about the Platform or product experiences ("Feedback"), you grant Cxperia and the relevant Brand a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, non-exclusive, sublicensable and transferable license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose without any obligation to compensate you.
When you access a product experience, the Brand is the data controller for your personal data, including your email address, Glowies balance, redemption history, and any feedback you provide. Cxperia acts as a data processor on behalf of the Brand. For information about how your data is processed, please review the Brand's privacy policy or contact the Brand directly.
Cxperia's collection and use of data in its capacity as a technology provider is governed by our Privacy Policy. By using the Platform, you also agree to our Privacy Policy.
You have certain rights regarding your personal data under applicable data protection laws, including the right to access, rectify, erase, restrict processing, object to processing, and data portability. To exercise these rights, you should contact the Brand directly, as the Brand is the data controller for your personal data.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including suspending or terminating access to product experiences and reporting such activities to law enforcement authorities.
YOU UNDERSTAND AND AGREE THAT YOUR ACCESS TO AND USE OF PRODUCT EXPERIENCES IS AT YOUR OWN RISK. THE PLATFORM AND PRODUCT EXPERIENCES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THAT WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES OF DESIGN, MERCHANTABILITY, TITLE, QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CXPERIA DOES NOT WARRANT THAT THE PLATFORM OR PRODUCT EXPERIENCES WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, ACHIEVE ANY INTENDED RESULT, BE SECURE, ACCURATE, COMPLETE, FREE OF HARMFUL CODE OR ERROR FREE. CXPERIA DOES NOT WARRANT THE AVAILABILITY OF ANY SPECIFIC EARNING METHOD, TIER BENEFIT, OR REDEMPTION OFFER. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
TO THE MAXIMUM EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT WILL CXPERIA, OR ITS AFFILIATES, PARENTS, SUBSIDIARIES, LICENSORS AND PARTNERS AND OUR AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, SUPPLIERS, SUCCESSORS AND ASSIGNS BE LIABLE UNDER OR IN CONNECTION WITH THIS AGREEMENT OR ITS SUBJECT MATTER FOR ANY: (I) LOSS OF USE, LOST PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, OR COSTS OF PROCURING SUBSTITUTE SERVICES; (II) LOSS, DAMAGE, CORRUPTION OR RECOVERY OF DATA; OR (III) CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, AGGRAVATED, PUNITIVE OR EXEMPLARY DAMAGES.
IN NO EVENT WILL CXPERIA BE LIABLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING, THEFT OR OTHER UNAUTHORIZED ACCESS TO OR USE OF THE PLATFORM OR YOUR EMAIL ADDRESS, INCLUDING ANY LOSS OF GLOWIES BALANCES.
IN NO EVENT WILL CXPERIA BE LIABLE FOR ANY UNFULFILLED, EXPIRED, OR MISLEADING REDEMPTION OFFERS, OR FOR ANY ACTIONS OR OMISSIONS OF BRANDS. ANY DISPUTES REGARDING REDEMPTION OFFERS OR REWARDS MUST BE RESOLVED DIRECTLY WITH THE BRAND.
IN NO EVENT WILL CXPERIA BE LIABLE UNDER OR IN CONNECTION WITH THIS AGREEMENT OR ITS SUBJECT MATTER, IN THE AGGREGATE, FOR AN AMOUNT EXCEEDING €10,000.
We reserve the right to immediately suspend or terminate your access to product experiences in our sole discretion, including where you breach this Agreement or Applicable Law.
Brands may terminate their loyalty programs or product experiences at any time. If a Brand terminates its program, your access to that Brand's product experience will terminate, and any Glowies balances associated with that Brand may be forfeited unless otherwise specified by the Brand.
Upon termination of your access to a product experience, your right to access and use that product experience will terminate immediately. Cxperia may delete your Glowies balances and associated data in accordance with our data retention policies and applicable law.
This Agreement represents the entire understanding between you and Cxperia with respect to your use of product experiences accessed through the Platform.
If any term of this Agreement is found to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect, invalidate or render unenforceable: (i) any other term of this Agreement; or (ii) the same term in any other jurisdiction.
This Agreement is governed by and is to be construed in accordance with the laws of France, without giving effect to any choice or conflict of law rule in any jurisdiction or the United Nations Convention on Contracts for the International Sale of Goods. You will bring any action or proceeding arising from or relating to this Agreement only in the courts located in Paris, France and you irrevocably submit to such exclusive jurisdiction and venue.
